TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale ("Terms of Sale") govern all purchases made on honeathletic.com (the "Site"), operated by Hone Athletic. By placing an order, you accept these Terms of Sale in full.

These Terms of Sale supplement our Terms of Service. In case of conflict between the two, these Terms of Sale prevail for matters relating to purchase, payment, delivery, and refunds.

2. PRODUCTS

The products offered for sale are those displayed on the Site at the time of order, subject to availability. We do our best to describe each product accurately, including materials, dimensions, and intended use.

Slight variations in color or finish may occur due to monitor settings or supplier batches and do not constitute a defect.

3. PRICES

All prices are displayed in US Dollars (USD) and include any applicable French VAT under the auto-entrepreneur VAT exemption regime ("TVA non applicable, art. 293 B du CGI").

Prices may exclude shipping costs, customs duties, or import taxes for international orders. These additional costs are calculated at checkout or charged separately by your local customs authority.

We reserve the right to modify prices at any time. The price applicable to your order is the price displayed at the time you confirm your purchase.

4. ORDERS

Orders are placed through the Site. An order is final once you:
- Confirm the items in your cart
- Provide accurate shipping and billing information
- Validate payment

You will receive an order confirmation email summarizing your purchase. This confirmation does not constitute final acceptance — we reserve the right to refuse or cancel any order in case of:
- Stock unavailability
- Pricing or description error
- Suspected fraud or unauthorized payment
- Shipping to unavailable destinations

If we cancel your order, you will be refunded in full within 10 business days.

5. PAYMENT

Payment is due in full at the time of order. We accept:
- Credit and debit cards (Visa, Mastercard, American Express)
- PayPal
- Apple Pay
- Shop Pay

Payments are processed securely by Shopify Payments, Stripe, and PayPal. We never store your card details on our servers.

In case of payment failure, the order will not be processed.

6. DELIVERY

Delivery terms are detailed in our Shipping Policy.

Summary:
- United States: 7 to 14 business days
- United Kingdom: 10 to 15 business days
- Canada: 10 to 15 business days
- Free shipping on orders over $50 USD

Delivery times are estimates and start from the day your order ships, not the day it was placed. Delays caused by carriers, customs, or weather are not the responsibility of Hone Athletic.

Risk of loss transfers to you upon delivery confirmation by the carrier.

7. RIGHT OF WITHDRAWAL (EU & UK CONSUMERS)

Consumers based in the European Union or the United Kingdom have a statutory right to withdraw from this contract within 14 days of receiving their order, without giving any reason.

To exercise this right, email contact@honeathletic.com before the end of the 14-day period, stating your intent to withdraw, with your order number.

You then have 14 days to return the items in their original condition. Return shipping costs are your responsibility, unless the product is defective or non-conforming.

Refunds will be issued within 14 days of receiving the returned item, using the original payment method.

This statutory right is in addition to our extended 30-day return policy described in our Refund and Return Policy.

8. RETURNS & REFUNDS

Returns and refunds are governed by our Refund and Return Policy. Key points:
- 30 days from delivery to request a return
- Items must be in new or lightly used condition
- Customer pays return shipping (except for defective items)
- Refunds processed within 10 business days of receiving the return

9. WARRANTIES

All products sold on the Site are covered by the legal warranties applicable in your country of residence, including:

- For EU and UK consumers: the legal warranty of conformity (2 years) and the warranty against hidden defects under applicable consumer protection law.
- For US and Canada consumers: any applicable implied warranties under your state or provincial law.

Nothing in these Terms of Sale reduces your statutory consumer rights.

10. INTENDED USE

Hone Athletic products are athletic accessories intended for general training use by healthy adults. Misuse, abuse, or use beyond the intended scope (extreme loads, commercial gym use unless specified, etc.) is not covered by the warranty.

Consult a qualified medical professional before starting any new training regimen.

11. INTELLECTUAL PROPERTY

All product designs, photography, branding, and Site content remain the exclusive property of Hone Athletic or its licensors. Purchase of a product does not grant you any intellectual property rights over the brand or its content.

12. LIABILITY

To the maximum extent permitted by law, our liability is limited to the amount you paid for the product giving rise to the claim. Nothing in these Terms of Sale excludes liability that cannot be excluded under applicable consumer law.

13. GOVERNING LAW & DISPUTES

These Terms of Sale are governed by French law.

For consumers based in the EU, UK, US, or Canada, mandatory consumer protections in your country of residence continue to apply.

In case of dispute, please first contact us at contact@honeathletic.com to seek an amicable resolution. If unresolved, competent French courts will have jurisdiction, subject to mandatory consumer law in your country.
